These Terms of Use (“Terms”) govern your use of the FitnessLi app and related services, provided by Mindroshan UG (haftungsbeschränkt), Zum Isetal 1, 38518 Gifhorn, Germany (“we”, “us”). By creating an account or using the app, you agree to these Terms. If you do not agree, please do not use the app.
Important health notice: FitnessLi provides fitness, calorie, and nutrition estimates for general informational purposes only. It is not a medical device and does not provide medical, nutritional, or professional advice. Always consult a qualified professional before starting any diet or exercise program, and stop if you feel unwell.
1. Eligibility
You must be at least 16 years old to use FitnessLi. By using the app you confirm that you meet this requirement and that the information you provide is accurate.
2. Your account
You are responsible for keeping your sign-in method secure and for activity under your account. Notify us at info@mindroshan.com if you suspect unauthorised use.
3. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use FitnessLi for your own non-commercial fitness and nutrition tracking. You may not copy, reverse-engineer, resell, or attempt to extract our content or databases except as permitted by law.
4. Subscriptions, billing & trials
- FitnessLi offers an optional Premium subscription. Subscriptions are sold and billed by Apple (App Store) or Google (Google Play) through your store account; we manage entitlements via RevenueCat.
- Subscriptions auto-renew at the end of each period unless cancelled at least 24 hours before the end of the current period. Your store account is charged for renewal within 24 hours before the period ends.
- Any free trial automatically converts to a paid subscription unless you cancel before it ends. Unused trial time is forfeited when you purchase a subscription.
- Manage or cancel your subscription any time in your App Store or Google Play account settings. Refunds are handled by Apple or Google under their respective policies.
5. AI features and estimates
Premium includes AI-assisted food analysis from photos. AI results — and all calorie and nutrition values in the app, whether from AI, our food database, or your own entries — are estimates and may be inaccurate. Do not rely on them for medical, clinical, or allergen-critical decisions. You are responsible for verifying information that matters to your health.
6. Third-party data
Product and nutrition data may come from Open Food Facts (ODbL / DbCL; images CC BY-SA 3.0) and the USDA (public domain). This data is community- and third-party-sourced and is provided “as is” without warranty of accuracy or completeness. See our Imprint for attribution details.
7. Acceptable use
You agree not to misuse the service, including by attempting to disrupt it, access it without authorisation, scrape it, exceed fair-use limits, or use it unlawfully.
8. Intellectual property
FitnessLi, its design, code, and original content are owned by Mindroshan UG and protected by law. Data you enter remains yours; you grant us the limited rights needed to operate the service for you (see our Privacy Policy).
9. Disclaimers & liability
The service is provided “as is” to the extent permitted by law. Nothing in these Terms limits our liability for injury to life, body, or health, for intent or gross negligence, or under mandatory statutory provisions (including the German Product Liability Act). For slight negligence we are liable only for breach of a material contractual obligation, limited to the foreseeable, typical damage. Your statutory consumer rights remain unaffected.
10. Termination
You may stop using FitnessLi and delete your account at any time in the app under Profile → Account → Delete account. We may suspend or terminate access if you materially breach these Terms.
11. App Store terms (Apple)
These Terms are between you and Mindroshan UG, not with Apple. Apple has no obligation to provide support or maintenance for the app. To the extent the app is acquired through the App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.
12. Changes to these Terms
We may update these Terms when the service or the law changes. The current version is always available here, with the date of the last update shown at the top. Continued use after an update means you accept the revised Terms.
13. Governing law
These Terms are governed by the law of the Federal Republic of Germany, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of your country of residence remain unaffected.
